Terms of Service
Please read all before commissioning me!
By commissioning me, you have read and are agreeing to my terms of service. Any statement can be bound to change if discussed with me, the artist, prior to the commission.If there are any questions regarding the TOS please feel free to contact me.google docs version : here
General tos
• I have the right to refuse commissions according to my discernment, if I feel it is out of my skill range or if I feel uncomfortable with it. Please check my Dos and Don’ts before requesting a commission.• Do not copy, steal, edit, trace over my art or claim it as your own.• All commissions are for personal use only by default. No commercial use allowed unless requested by the client and agreed upon by both parties. Check Commercial Use section for more info• I do not allow clients to use the commissions as or for nfts or cryptocurrency related advertisements or profits.• I do not allow using commissioned works or my art in general to train AIs. This includes uploading them to AI websites.• Commissions are digital copies only. No physical copy and shipping required.• I am not responsible for keeping copies of the commission files after sending them to the client.• Prices indicated are base prices, and may change due to complexity of design, extras, rush and commercial fees.• No refunds once I start drawing/finish the commission
I will not be held responsible if the commissioner has not or did not read my terms of service and still proceeded to commission me.• Failure to follow the Terms of Service may result in being blacklisted and cancellation of the commission with no refunds depending on the situation.
Payment
• Do not send me any payments before I confirm that I have accepted your commission. Unauthorized payments via paypal or ko-fi will be considered as donations. Ko-fi commissions are exempt from this bc they are pay as you order.• Full payment is required before I start working on a commission. Partial payment plans can be discussed if the commission reaches a certain price ($70 and above)• Payment will be PayPal only via invoice or ko-fi depending on the commission• No refunds once I start drawing/finish the commission• Refunds will only be given if I cannot finish it due to personal reasons• Any extra amount paid from the agreed upon price/minimum price will be considered as tips and also non-refundable once the commission is finished.
Process
• After receiving payment I will send a sketch and do revisions if there are any.• Once the sketch has been approved I will start on the lineart and then color it• You will be sent updates/pics for each of the processes (sketch, lineart, flat coloring, shaded/finished drawing) or if you ask for updates. After sending updates, I need explicit confirmation that everything is ok and good to proceed to the next process• Turnaround time or TAT may take from 1-4 weeks at earliest or up to 3 months latest, this is factoring in commission complexity, queue, personal schedule etc. I will inform the client if the commission may take longer than usual due to personal reasons or if anything suddenly comes up.• Please do not rush me with commissions and bombard me with update requests. If you have a deadline, inform me beforehand or pay a rush fee. Rush fees will vary depending on the situation
References
• There must be a decent clear full colored full-body reference of the character.• If there is a reference with flat colors please include it for easier and more accurate colorpicking. Preferably the reference picture is in 2d but 3d is ok• If you’re commissioning a half body drawing a reference just up til half the body is fine same goes for busts etc.• If you want something specific (pose,expression etc.) please let me know before I start and feel free to include reference images of those.• I do not accept written descriptions of a character or a character “stitched-together” from various images (ex. Sending me many pictures and going “pls draw my oc she has hair like this one and her top looks like this pic and I want her skirt like this other pic blah blah” That would fall under custom design commissions.
Revisions
• There can only be 2 major revisions of the sketch (ex. Changing the pose etc.) and also 2 for minor revisions.• Revisions are counted per request for revisions not for revisions themselves. So please be clear when asking (example: “Can you give the eyes heart pupils instead, make the ribbon bigger and make the bangs a bit shorter” = 1 minor revision; “Can you make the head face left and change the arm pose to hide the face a bit and have her standing instead of sitting” = 1 major revision)• Rejected/scrapped sketches cannot be used by the commissioner and I reserved the right to use them for future works• Major changes (pose, clothing, hairstyle, colors etc.) after the sketch is approved will result in an additional charge to be determined between the client and the artist. I will only continue the commission once I have been paid the full additional payment. A maximum of 2 major changes are allowed.• Once shading has begun, there will be no more revisions allowed concerning the base colors. (Ex. “Actually, can you make the blue dress orange?” no)

(Rights, Usage & Credits)
• All commissioned works are for non-commercial/personal use only by default. Commercial use will have extra fees.• Personal use such as social media icons, banners etc. is ok. Printing /making keychains/ charms etc. for yourself is also allowed. If unsure whether it is personal use then feel free to ask me before commissioning• Again I do not allow clients to use the commissions as or for nfts or cryptocurrency related advertisements or profits and using commissioned works or my art in general to train AIs• When reposting/using the commission please credit me properly (mentioning me directly or linking to my accounts etc.) and do not claim that you made it.• I have the right to post the art commissioned and related things such as wip shots/ speedpaints or use it as commissions example unless requested otherwise with valid reason.• Clients may not at any time modify, edit, change the commissioned work without permission from the artist.
Commercial Use
• Commercial use means that the commissioned work is monetized. It includes but is not limited to usage on streams/broadcast, promotions, merchandise etc.• You may request commercial use after the commission is done if you’ve changed your mind but it is preferable that you request it while giving the commission request.• You may not, however, cancel the request for commercial use once it has been agreed upon by both client and artist and the commission has been started on.• The extra fees for commercial use will depend on which tier the client wants. The client may not avail higher tier benefits that they did not pay for.
Tier 1
for streamers/vtubers
• 175% of the commission price• 200% of the custom commission/adoptable price if the design you commissioned me is to be used as a vtuber/pngtuber and will include the tier 1 benefits.• The art is used as part of a brand/promotion. Examples are using the art on videos, promotion materials and streaming/monetization platforms.• Other uses: stream website overlays, thumbnails, stream schedule advertisement, Vtuber and PNGtuber assets, turning into merchandise meant to be given away to fans etc. but not profited off.
Tier 2
for merch
• 500% of the commission price• Tier 1 benefits are also included here
This tier is for making and selling any merchandise featuring or using the commissioned work.• Examples: keychains, standees, shirts, stickers, prints etc.
Blacklisting
• If a client is being unreasonable or rude they will be blacklisted. Meaning they will be banned from commissioning me and will be added to a public blacklist along with the reason they have been blacklisted.• Causes of being blacklisted includes: unjustified chargebacks, unprovoked slander, behaving rudely etc.• If you file a chargeback against me the commission is automatically cancelled and you lose all rights to everything you commissioned me. I reserve the right to reuse/repurpose/resell the pose/design of the commissioned art.
Rates and examples
Note there will be:
• extra charge for complex designs
• only simple backrounds
• one character per drawing
